Terms of use

1. Service provider

The Place service is provided by the team responsible for Place, as owner and operator of the Place digital service. Legal contact: hello@place.app.

2. Description of the service

Place is a digital platform for garden planning and management and botanical knowledge, available mainly via an iOS application and, complementarily, via an informational website and public catalog.

Agronomic, weather or treatment recommendations are indicative only. Final decisions on sowing, irrigation, plant protection or harvest are yours and must comply with your local context and applicable regulations.

3. Acceptance and eligibility

You must have legal capacity to contract under the law of your country of residence. If you use Place on behalf of an organisation, you represent that you have authority to bind it to these terms.

Use of the service implies acceptance of these terms and our Privacy policy.

4. Account and security

You are responsible for keeping your credentials and device access confidential. You must notify us immediately of any unauthorised use at hello@place.app.

We may suspend or close accounts that breach these terms, engage in fraudulent use or compromise service security.

5. Plans and pricing

Place offers, among others, the free Esencia plan and the Reino subscription with extended features. Prices published on the web (e.g. €4.99/month or €39.99/year in the EU) are indicative; the final amount and currency are determined by Apple at purchase on the App Store.

We may change prices, quota limits or plan features with reasonable prior notice where law or store conditions allow.

6. Subscriptions, free trial and App Store

Reino subscriptions are purchased through the Apple App Store. The free trial period (14 days unless otherwise promoted) and auto-renewal are governed by Apple’s terms and your Apple ID settings.

You can cancel renewal in Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period; no pro-rata refund unless required by law or Apple.

Billing or refund claims for in-app purchases should be directed primarily to Apple under its policies; we will assist you reasonably if you contact us.

7. Permitted use

You may use Place for lawful personal or professional purposes related to crop management and botanical learning, respecting the law, these terms and third-party rights.

8. Prohibited use

You must not:

• Reverse engineer, decompile or attempt to extract source code except as permitted by law.
• Use the service for spam, malware, unauthorised mass scraping or infrastructure overload.
• Impersonate others, breach third-party accounts or publish unlawful, defamatory or IP-infringing content.
• Resell or sublicense access to the service without written authorisation.

9. Intellectual property

Place, its brand, interface, catalog editorial texts, botanical illustrations and software are protected by intellectual and industrial property rights of the Place service owner or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the service under these terms. Content you upload (photos, notes) remains yours; you grant us a licence to host and display it within the service.

10. Availability and service changes

We strive to keep Place available but do not guarantee uninterrupted operation. Maintenance, updates or interruptions may occur for technical or force majeure reasons.

We may add, modify or remove features; for material adverse changes for paying subscribers we will give prior notice where reasonable.

11. Limitation of liability

To the extent permitted by applicable law, Place is provided «as is». We are not liable for indirect damages, lost profits or data loss arising from use of the service, except for wilful misconduct or gross negligence, or where mandatory law (e.g. EU consumers) does not allow such limitation.

Our total cumulative liability for claims related to the paid service is limited, unless mandatory law provides otherwise, to the amount you paid in the twelve months before the event giving rise to the claim.

12. Termination and suspension

You may stop using Place and request account deletion at any time by contacting hello@place.app or via in-app options when available.

We may suspend or terminate access for serious breach of these terms, subscription non-payment (per Apple rules) or legal requirement.

13. Data protection

Personal data processing is described in our Privacy policy, available at https://placethegarden.es/privacidad. It forms an integral part of these terms.

14. Governing law and jurisdiction

These terms are governed by Spanish law and, where applicable, European Union law on consumer and digital services.

If you are a consumer resident in the EU, you may bring proceedings in the courts of your domicile where the law allows. Otherwise, the parties submit to the courts of Madrid, unless mandatory law provides otherwise.

15. Final provisions

If any clause is invalid, the remainder stays in force. Failure to enforce a right is not a waiver. These terms constitute the entire agreement between you and the Place service owner regarding use of Place, except for particular conditions stated in writing.

We may update these terms; the current version will be published with an update date. Continued use after material changes implies acceptance, unless the law requires explicit consent.
